Success for Mesothelioma Sufferers.

In April 2013 the legal market changed following the implementation of the Legal Aid, Sentencing and Punishment of Offenders Act (LASPO). One of the changes imposed related to the way personal injury and illness claims were funded. Prior to the Act, successful claimants were entitled to recover the full costs of bringing a personal injury claim from the defendants, including the solicitors success fee and an after the event legal insurance premium. The act removed this obligation, meaning claimants had to pay these costs to their solicitors out of the compensation they received. In an exception to the changes brought in by the act, individuals and families wishing to make a mesothelioma compensation claim were still entitled to recover all their legal costs from the defendant. This has allowed mesothelioma claimants to retain 100% of their compensation. The Government previously tried to remove the exemption in June 2014, stating that a review had shown the exemption was no longer required. This decision has been successfully challenged by a mesothelioma victims support group in the High Court. Mr Justice Williams cited that the review into the funding of mesothelioma compensation claims had not been properly conducted, and indicated that the Government should carry out a proper review into this issue. Mesothelioma is an incurable lung cancer caused by historic exposure to asbestos. Individuals, and the families of the deceased, can make a compensation claim despite the exposure of asbestos happening decades ago. Claims can also now be brought if no insurer can be found for a former employer, following an agreement between the insurance industry and the government in early 2014. This ruling has, for the time being, safeguarded the compensation awards of thousands of people who have, and will, be impacted by a devastating industrial illness caused by historic asbestos exposure.
