Client receives £25,000 more for the under settlement of her claim

Mrs P was employed as a secretary by the Probation Department of a North of England city. 

Much of her work involved taking shorthand notes of meetings and her claim was that she had been given so much work to do that she had developed a repetitive strain injury to her left arm.

She had instructed previous solicitors who had corresponded with her employers and eventually they had made an offer of £5,000.00 to settle the claim. 

The solicitors instructed Counsel to advise on the offer and the Barrister advised that in his opinion any offer of settlement should be accepted because there was little, if no merit in the claim.

Relying on the advice of her solicitor and Barrister the case settled for that sum. 

The client was unhappy with the settlement and therefore instructed Paul Carvis at this firm to consider whether or not the case had been under settled by her previous solicitors. 

Having reviewed the whole of the file it was obvious that neither the solicitors nor the Barrister instructed by them had properly considered the matter and that the Barrister’s advice was extremely poor and that in fact the client had a very good case based upon the fact that she had repeatedly complained about the amount of work that she was having to undertake and yet nothing was done until after she had her operation.

In addition to that her previous solicitors had not properly considered the financial loss that the client had suffered.

In addition to her claim for pain and suffering she had also been down graded on the pay scale as a result of not being able to continue as a secretary taking minutes at important meetings and instead was given a less remunerated clerical post and that would have affected her income well into the future.

Mr Carvis entered into considerable correspondence and negotiation with the insurers acting for the previous solicitors and thereafter solicitors instructed by the insurance company until eventually the client received £25,000.00 more for the under settlement of her claim.
