Claimant Awarded £2,800.00 After Contracting Food Poisoning On Holiday

In August 2015 Mr K booked a holiday for himself, his partner and their children through a tour operator, staying at a hotel in Egypt.

The hotel was booked on an all inclusive basis and at no time during his holiday did he eat out of the hotel.

After ten of the fourteen days that he had booked for the holiday he began to feel unwell and started having symptoms of gastroenteritis.  He developed a fever and went to see the doctor in the hotel who gave him injections and put him on a drip.

He continued to have severe stomach cramps for the rest of the holiday, which was effectively ruined.

On his return to this country he contacted Yorkshire’s Injury Lawyers, who on his behalf made a claim against the tour operator seeking compensation for his pain and suffering and for the financial losses which included loss of enjoyment of the holiday.

Initially the tour operator contested liability, arguing that Mr K could have developed gastroenteritis from eating elsewhere, but we convinced them that being an all inclusive holiday the only meals that he consumed whilst at the resort were at the hotel.

Eventually they offered £2,100 plus costs in settlement of the claim but that offer was rejected.  Eventually the claim settled in the sum of £2,800. 

On receipt of the money Mr K e-mailed the solicitor at this firm who handled the claim, thanking him for his efforts in recovering compensation on his behalf and for fighting the denial of liability from the tour operator.
