£5,000 for claimant who sustained whiplash type injuries.

Yorkshire’s Injury Lawyers Ltd recently acted for a Claimant injured in a road traffic accident.  The Claimant was driving a friend home in his works van when he approached a roundabout intending to take the third of four exits.  There were two lanes in the entrance to the roundabout and he was in the left hand lane and as he approached the third exit he indicated left when he was hit on the nearside by another vehicle. 

Liability was initially denied by the third party who argued that the Claimant  had crossed in front of her car without indicating and was therefore liable for the accident. 

Legal proceedings were issued.  The Claimant’s version of events was that the third party was in the wrong lane in that she had approached the roundabout in the left hand lane when she was taking the fourth exit which is effectively a right hand turn and therefore she should have been in the right hand lane.

The claim was defended until 3 weeks before trial when following negotiations liability was conceded.  The Claimant sustained whiplash injuries to his neck, shoulder and lower back that resolved in the 13 months and damages were agreed in the sum of £5,000.00.
